MoneyTree Subscription Policy

Introduction

This Subscription Policy ("Policy") governs the subscription model provided by MoneyTree Realty Services Private Limited, a registered RERA agent operating in multiple states across India ("Company").

By subscribing via our website or mobile application, you ("Subscriber") agree to comply with this Policy, our General Terms of Use, Privacy Policy, and any other applicable policies or amendments thereto from time to time.

Interpretation & Definitions

Interpretation

The headings in this Policy are for convenience only and shall not affect its interpretation. Words denoting the singular include the plural and vice versa. References to any law or regulation shall be deemed to include all amendments, modifications, or re-enactments thereof. Terms not defined specifically under clause 2.2 but defined under our General Terms of Use, Privacy Policy or any other policy shall bear the said meaning.

Definitions

• Company: MoneyTree Realty Services Private Limited.
• Commission: The payment made to the Subscriber by the Company upon the successful conversion of a Lead into an investment or sale, as per the terms of the applicable Subscription Plan.
• General Terms of Use: The general terms and conditions governing the use of the Company’s website and application.
• Investment or Sale: A successful transaction where a Lead provided by the Subscriber results in either a commitment by the proposed investor of funds into a real estate project, or the purchase of a real estate property, unit, or asset, as defined by the Company. The determination of whether a Lead has resulted in an investment or sale shall be at the sole discretion of the Company.
• Lead: Requisite information provided by the Subscriber about a potential investor interested in real estate projects.
• Payment Gateway: Any external payment gateway or financial service provider used to process the Subscription Fee.
• Privacy Policy: The Company’s policy regarding the collection, use, and protection of user data.
• Refund Policy: The Refund Policy of the Company.
• Subscriber: Any individual who subscribes to the Company’s services by paying the applicable subscription fee for the subscribed plan.
• Subscription: The process of enrollment by a Subscriber under any Subscription Plan by payment of the requisite Subscription Fee.
• Subscription Model: The framework established by the Company wherein the Subscriber provides leads of potential investors or buyers interested in real estate projects and, in return, the Company offers commission-based compensation upon the successful conversion of such leads into confirmed investments or sales, as per the terms of the chosen subscription plan.
• Subscription Fee: The one-time, non-refundable fee paid by the Subscriber in respect of the chosen Subscription Plan.
• Subscription Plan: The different plans offered by the Company.

Nature of Subscription

This Subscription Model enables individuals to submit leads of potential investors or buyers interested in real estate projects. The Company will compensate the Subscriber with a commission upon the successful conversion of a Lead into a confirmed investment or sale, based on the commission rate specified under the selected Subscription Plan.

Nothing in this Policy shall be construed to create an agency, partnership, joint venture, or employment relationship between the Company and the Subscriber. The Subscriber is an independent party providing leads under a commission-based arrangement.

Subscription Plans & Fees

The Subscription Fee is a one-time, non-refundable payment. Subscribers may choose from different Subscription Plans as listed on the Company’s application and website.

The Company reserves the right to modify Subscription Plans, including pricing, commission structure, and other terms, at any time without prior notice.

Payment Terms

Payments for subscriptions shall be made using third-party Payment Gateways integrated with the Company’s website and application.

A Subscription is confirmed only upon successful payment of the one-time Subscription Fee. The Company is not responsible for any payment failures, technical issues, or disputes arising from the transactions between the Subscriber and Payment Gateways.

Commission Payout

Commission payments will be made only upon the successful conversion of a Lead into an investment or sale as per the applicable Subscription Plan.

The Company has the sole discretion to determine the eligibility and amount of commission payable based on internal verification. Any commission payouts will be processed within a reasonable period of 30 days, subject to the completion of all necessary formalities.

The Company reserves the right to withhold or reject commission payments in case of fraudulent or misleading Leads. Please note that if the Subscriber cancels their Subscription, they will forfeit their right to any future commission.

No Refund

The subscription fee is strictly non-refundable once the payment is successfully processed. Refund claims shall not be entertained under any circumstances, except as explicitly stated in the Company’s Refund Policy.

Warranties and Limitations on Liability

The Company does not guarantee that its website or application services will be uninterrupted, error-free, or free from technical issues. The Company shall not be liable for any disruptions, delays, or inaccuracies in service availability.

The Subscriber agrees to waive all claims for special, indirect, incidental, or consequential damages against the Company.

The Subscription Model does not create a seller-consumer or service provider-consumer relationship between the Company and the Subscriber as provided under the Consumer Protection Act, 2019.

The Subscriber acknowledges that their engagement with the Company is solely governed by this Policy and the applicable terms of the Subscription Plan. The Company shall not be liable for any delay or failure in performance due to events beyond its reasonable control, including but not limited to natural disasters, acts of government, cyber-attacks, or technical failures.

Class Action Waiver

The Subscriber agrees that any dispute, claim, or controversy arising out of or relating to this Subscription Policy, the Subscription Model, Subscription Plan or any related transactions shall be resolved on an individual basis only. The Subscriber waives any right to participate in a class action, collective action, or any similar proceeding against the Company, whether as a plaintiff, class member, or in any other capacity.

Any claims must be brought in an individual capacity, and no claims may be consolidated or joined with those of any other party. All legal proceedings shall be conducted solely on an individual basis and not in a representative or class capacity. If this Class Action Waiver is found to be unenforceable in any jurisdiction, such provision shall be severed, and the remaining provisions shall continue to apply in full force and effect.

Governing Laws & Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of India, and any disputes arising under this Policy or Subscription Plan shall be subject to the exclusive jurisdiction of the courts of NCT of Delhi.

Modification & Termination

The Company reserves the right to modify, amend, or discontinue this Subscription Policy at any time with one-month prior notice. In the event of a substantial change in this Subscription Policy, the Subscriber will be notified of such change one month prior to its enforcement.

The Company may terminate a subscription without liability in case of a violation of this Policy, submission of fraudulent leads, or any other breach of the Terms of Use.

Survival

If any provision of this Policy is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The Company’s failure to enforce any provision of this Policy shall not be deemed a waiver of its rights to enforce such provision at a later stage.

Acceptance of Term

By subscribing to our services, the Subscriber acknowledges having read, understood, and agreed to the terms and conditions of this Subscription Policy, the Refund Policy, Privacy Policy, and the General Terms of Use.
